Jimmy wants me to pay prescribed debt, as i havent heard anything from RCS in years, no phone call, no letter of demand, nothing, so please close your file on me as the debt is prescribed. I refuse to pay as the debt is prescribed as per the prescription act. i havent acknowledged this for th epast 3years, made no payment and havent received a summons fro it, therefore i am not legally bound to pay for it, I refuse to pay on this grounds. The Prescription Act is intended to give consumers protection against debt collectors hounding to pay an old debt that we can barely recall. In short, according to the Prescription Act, if, in the past three years you have not made any payment towards settling a debt, acknowledged owing the debt in any way - including over the phone - agreed to pay it, or been summonsed in respect of it, it has prescribed, I can raise this as a defence when asked to pay it.
