Defective since day 1, yet I have to pay to cancel

I have a contract with Althech for a BB Z10. The phone was faulty within 2 weeks and it got replaced. The second phone got faulty just before six months of the contract, and again the store got credited for a new phone.

As it is the second one that was faulty, I do not wish to take the same phone again, as I know it will not be credited again, but repaired next time.

I asked if I could get a different phone and was advised that it is possible, provided the phone costs the same, or else I need to pay the difference. Because of my contract, the only option that will not end up in a more expensive month to month is the Q10, but this has a paying of R1180.The other option I got given was to take the Samsung Galazy S4 Mini with no paying, but will have to add data onto my contract, at an additional charge p/month.

I rather want to cancel my contract but was advised that I would have to pay over R7000.I asked that the money for the phone get deducted as the store has been credited and I haven't taken the phone. I was told this was not possible and I will have to pay the whole amount.

I want to cancel this contract but find it unfair I have to pay, as the phone has been defective from day 1!
