Blackberry Torch not working!!!

I upgraded my contract in February 2012 and took a new Blackberry Torch. I pay over R700 per month for my phone and services and the phone does not work!! My keypad scrolls around by itself; I am unable to send/receive mms or photo's via bbm; my phone randomly re-boots itself (at least 5 times a week) whilst I'm on the phone!! I've had endless phonecalls with Nashua and Vodacom to change settings, download and upgrade new software and none of it has worked. Now, Nashua will only repair, perhaps replace my phone but not issue me a different phone, although the Torch was discontinued a few months after I got my "new" phone. I am 8 and a half months pregnant and don't have a working phone to contact anyone should something happen. As a consumer I pay my bill each month but the supplier is not living up to it's end of the contract. According to the consumer protection act, I have the right to a WORKING PHONE. I am frustrated with "well that's all we can do and we won't give you a different phone"!!! I do not want a Blackberry Torch as it is a useless phone!!!
