New Blackberry in for service after one month

I have been a Vodacom client for many years and so when my son asked for a new phone for Christmas, we did not hesitate to leave the previous network that he was on and change to Vodacom. In December 2012 I bought him his brand new Blackberry phone, but already in the first week it started overheating and so, after the Christmas season, we returned it to Gateway Vodacom branch. The attendant told us this is a common problem and the company will replace the phone with a refurbished one. I wanted a brand new phone, as we only had it for a few weeks, but was told that only after the fourth time of repairs, they will replace it with a brand new phone. We have battled with this phone for seven months now. It overheats, its battery life is short and it stalls for no reason. Yesterday we returned it to the Gateway branch and when I asked if this will now be replaced with a brand new phone, we were told that we should've asked for a new phone the first time and it is to late now. I asked if I could end the contract as we have not had good service this time to which the lady that helped us started becoming rude to me and told me that I just have to bear with the problems.
