Trading in bad faith

On the 24/04/13 I sent my blackberry 9300 to MTN DIrect store at MIDLANDS MALL (PMB) for repairs on a trackpad as my contract is still within the two year term, first Ricardo said they may quote me for repairing the side buttons and i said its fine as my concern was on the trackpad. after two weeks a lady called me and said they will not touch my phone cause the blackberry policy prescribe if the phone is somehow broken they must not do anything. i then tried to escalate the matter and Ricardo confirmed the policy provisions the store manager said i will need to come and transfer my information on my broken phone using some device and then perhaps other repairshops could help. on the 27/05/13 i went back to MTN Direct to discover that my phone was opened and the screen is scrambled and the phone is formatted. ( WHAT IS THIS NOW my phone could not be fixed because of the policy and now it has been further broken and my info missing how fair is that, MTN break my phone and now i must pay on top of it i pay blackberry services that i don't use (repairs are 21 days and I'm suffering) please help Pete
