Out of box failure

Got an upgrade in dec and I upgraded to blackberry ever since I got it it has not worked properly I took it in and was told it will take 5 days it took 13 days and I received no call informing me it would be late I finally receive a call to pick it up and once I have it it still does not work very I am very disappointed I need to know which steps to take to get my phone fixed or a new one
