Refusal to exchange faulty phone

I upgraded my handset on the 27th Of December. The handset began overheating while in use and randomly switching off within the first 3 days. This is a clear indication that the phone was faulty when sold. I then tried to take the phone to 3 different MTNs to exchange the phone and they all refused to exchange the phone, even though before I upgraded the contract the sales agent assured me that I could take the phone to any MTN store.

Now the store I upgraded at has forced me to send the phone for a warranty assessment even though it was faulty from the day I bought it. I then went to two stores for the warranty assessment and they did not want to accept the phone which delayed the process even further.

So now it has been 3 weeks and I am paying for a faulty phone that I havent even been able to use.

Is this how MTN conducts its business?

Since this phone was faulty from the start, the phone should be exchanged and not undergo warranty assessments or be fixed.
