SAMSUNG TAB NOT BEING REPAIRED

I sent my fone fone software upgrade at cellc newcastle 20/4/2013, Because it was not picking up cellc network. I come into cellc on 7/5/2013 n they say the fone has been physically damaged n I have to pay 4 repairs!!! How does it become physically damaged if no network is showing?
I called the technical department a few times before I sent it in for repairs and they told me its a sim card problem and must do a sim swap, n they told me to try another netwrk sim n see if it works, the other networt
Why should i pay for repairs when the fone is under warranty & i am paying for my contract fone???
09/05/2013 i called Denver at cellc repair centre for feedback on fone, he said that it was physically damaged and waiting for full report, he then called me back and said the board is damaged!! how can the board get damaged if the fone can not even open?
he then called me to say the fone is out warranty. as cellc only has 1 yr warranty
i then called samsung call centre, and the lady told me all samsung handsets have a 2 year warranty (1yr with samsung & 1yr with servioce provider)

PLEASE TELL ME WHY MY PHONE IS NOT GETTING FIXED AND ALWAYS MAKING EXCUSES!!!
