Brand new phone faulty

My wife upgraded from a Blackberry Curve 9300 to a Blackberry Bold 9900. Upon signing the contract we were told that we have 7 days to return the phone should there be a fault with it. When we got home my wife discovered that the "R" key was faulty. My wife took the phone back to the next morning only to be told that there is no such thing as a 7 days return policy and that it would have to be booked in for repairs which would take 7 working days. This is totally unacceptable as the phone is brand new and shouldn't require repairs in the first day of use. I contacted the shop manager to inform her that I wanted a new phone to be issued but this request was denied as it is against protocol. They had a technician look at the phone the following day. With no feedback a day later my wife went back into the store. She was told that there was no fault with the phone. She demonstrated the fault to the saleslady who agreed that there was indeed a problem. She informed the manager who then suggested that the phone be booked in and wait 7 days to hear whether they will issue a new one or not. The phone is brand new! It should be returned to the supplier and a new one issued immediately.
