OK WONT CANCEL MY CONTRACT THEY SAY MTN AT FAULT

On the 4th Nov 2012 i received my blackberry 9320. My mother applied for it cause i am unemployed. My husband pays the account. I applied cause i am pregnant and did not have a phone and this is a risk pregnancy and need to have a phone. On the 4th Nov 2012 i received my phone. Myself and my mother was not told about the 7 day return policy. On the 13th Nov 2012 i returned my phone for a replacement cause it was defective. They said i could not replace it because of the 7 day return policy, but nobody told us about it. Our Salesman Mr Maluleke No bsm09 NB first says that he told me. I remind them all that my mother fetched the phone and also was not told, he then says that he told us the day when we came to apply for the phone. That day he was checking to see if my mother "can" apply for the phone cause he told us she might not get the application, so how could he then tell us of the policy. HE DID NOT TELL US! I have returned my phone for repairs 4 times already and im now 6 months pregnant and my phone is still faulty. I AM PAYING FOR A DEFECTIVE PHONE AND IM AT RISK WITH MY PREGNANCY. This phone is not working most of the time, WHAT IF I HAVE AN EMERGENCY AND CANT CONTACT ANYONE
