Still no joy from Makro

Makro does not comply with Section 49 of the CPA.They are refusing to replace a tv that was bought with a defect in September 2012.I took it back within the 6 month period to be replaced. They refused, sent it in for assessment. Now they are saying that I damaged the tv myself. They can not prove that it was user damage, but still refuses to replace it. To repair the tv is going to cost R4 391.33.I bought the tv on special for R4 499.This is not economical to repair, and I also refuse to pay for this when the tv was bought with a defect. I am wondering if that is why the tv was on special, becuase they knew about the defects... Or that this specific model has been discontinued. Nobody told me about the 14 day return period, (which is not in line with the CPA anyway), and nobody told me that the warranty does not cover any screen problems. This is clearly in contravension to the CPA.Thandile admits that the 14 day period is not stated clearly, nor that it was explained to me on purchase of the tv, yet he still just shrugs and says that they are not going to replace the tv. My next step is to lodge a formal complaint with the Consumer Commission should I not receive an acceptable outcome.
