Samsung S3 Faulty

I bought a Samsung S3 on the 27 July 2013 at Foschini Vereeniging using my account and the phone was R6999 and insurance is R150 per month, it started giving problems in October, complaining of Data updates, background data software, freezing and settings not visible. We took it back to the shop for for than 4 times in less that 3 months and they said they took it to Vodacom and Samsung as suppliers it has been repaired but problems persists. We spoke to them and requested a new phone because we have been paying the insurance but they refused as it is I don't have a phone and my account is going up yet I am not happy and they told me there is nothing they can do for me and I must use that scrap I am not happy and want to take legal actions against them. They have thephone witrh them I told them I want a new phone
