My new fone does not download

I purchased a 9320 Blackberry on 23. 09.13 on the 9.10.13 I went back to report that my fone does not download to Millicent who said there's nothing she can do, she can only book my fone for repairs that will take 3-4 working weeks which is unfair I did not buy a second hand fone, I whent back on 10.10.13 I want a refund or an exchange for another fone she refused I feel robbed cause I'm stung with this fone and it is not working 100%.
