I am the sole owner of a small company called Visual 8 Creative cc. I produced some design work (ie: Logo and Corporate identity design) for a client TK Management Solutions (TKMS) and have not been paid in full as yet. My invoices date back to 29.08.12 (amount due: R9 804.00) and were due C.O.D according to all my documentation and the signed contracts.
I was contacted by their lawyer and asked to meet with client to settle out of court. After much delay on their side I went in for a meeting where their lawyer was present and was made to feel as though my only option for receipt of payment was to hand over all my work and I did so with the promise by both lawyer and client that I would be paid. I still did not receive payment.
I eventually appointed a lawyer to assist. Finally an agreement was reached on 7th May 2013 that TKMS had agreed to pay the outstanding balance on my invoices over four months. First payment to be made on the 17 May 2013, thereafter on the 15th of every month until the full outstanding amount was paid. To date only ONE of these payments has been made and no more. The TKMS lawyer is not returning my calls.
