As students my son and his friends rented a property in Herbert Baker Street in Groenkloof from Ansie Realty Properties. All dealings and the signing of the contract was made with Ansie van den Berg as Principal of the Estate Agency. They paid the deposit as well as the monthly rental amount over to the agency. As the rental contract expired at the end of January 2013 and 2 of the tenants moved out they have been asking Ansie van den Berg for the refund of their respective deposits.
According to the Rental Act 50 of 1999, all rental deposits must be kept in an interest bearing trust account by the rental agent. Ansie this morning told me that the deposits in dispute were paid over to the landlord and that she has nothing to do with it. Unfortunately this is not acceptable, and it is further in contravention of the Estate Agency Affairs Board's Code of Conduct. I want to warn any future tenants to be careful when dealing with Ansie Realty, as the above clearly reflects the unwillingness to act according to the guidelines laid down by the law.
