In Dec'12 I received a call from Jacklin Enterprises regarding the Disney Bookclub offer, to which I agreed they could post me a book parcel. I never collected nor signed for the parcel from the post office. In March'13, I received a statement requesting payment for the books, and immediately contact the office to which they gave me a tracking number. I took that to the post office however due to the postal strike at that time, there was no record of the parcel arriving at this office. I then emailed JE to cancel the order and to stop billing me. I heard nothing since then. Today, 14/11/2013 I receive a call from a debt collection company requesting payment or risk being blacklisted! What type of unscrupulous practice is this???
The onus is on Jacklin Enterprises to prove that I received the parcel. If they cannot, then how dare they expect me to pay for something I did not receive? The right thing to do is ensure that the client collected and signed for the parcel before billing the client, and if the track/trace shows that this did not occur then common sense tells you that the CLIENT DID NOT GET THE PACKAGE THEREFORE DO NOT EXPECT PAYMENT FROM THE CLIENT.
