Poor customer service and feedback

A few days before my wife gave birth to our son prematurely on the 27th April 2013 I had booked and paid a photographer to do pregnancy photo's.
Unfortunately I had to cancel because of my son being born earlier and I asked the photographer kindly for a refund as we no longer needed to do the pregnancy photo's.
This was on the 30th April 2013 and she replied stating that she could refund the money but she needed a few days to sort out a few things before refunding the money.
A week later I decided to follow up with no reply and one week after that I called her and she told me she still required more time and she would pay us when she could. Six weeks has passed since that time meaning it has been over two months and we are still waiting for our money.
I did email her after the phonecall mid May but she never responded to any of my emails and clearly I can see that she doesn't want to refund us the money.
I find it to be poor customer service and feedback from her part and she could of clearly stated that she needed an 'x' amount of time to pay or perhaps why she didnt want to pay us the money.
I am still following up with no reward...
Seems like this money has now been lost :( :(
