Auto Speed
Hole in gearbox housing

My clutch on my Runx RSi wore out and needed to be replace. SA warranties approved the work to be done at Autospeed in Somerset West in the Western Cape. The job was done in December 2012 and was told that the clutch was replaced, gearbox oil was changed, the flywheel was schemed and the gearbox housing/mounting bolts were replaced because they were broken. I was also told by Autospeed that the gearbox will leak oil in the beginning because the gearbox 'sweats' the oil out. While driving I experienced a burning oil smell now and then thinking is just the 'sweating' of the gearbox oil or just maybe that the clutch still has to wear in. I had my 160 500km service done on my car was told by the Toyota service agents that there was oil leaking from the gearbox. And after inspection it was found that there is a hole in the gearbox housing of my gearbox. The gearbox leaked through this whole and effectively caused the now and then smell I have been experiencing over the past couple of months. I took my car back to Autospeed today (01 May 2013) because Autospeed took the gearbox out to replace the clutch in Dec 2012. He replyed that it is not his fault.
Where do I stand?
