Harassment Five Years After Debt Has Prescribed

I had a loan account with Nedbank eight years ago and the full amount was not settled.

I did not receive all calls or communication from them whatsoever to advise that there was an amount still due and therefore thought all was settled.

I opened a bank account 7 years later and the moment I put money into the account, Nedbank unauthorizedly took the money from my account immediately! I now receive threatening smses stating that the amount will continue to be deducted from my bank account (I no longer have the Nedbank account open).

My problem - according to the Presciption Act of 1969, if in the past three years you have not made any payment towards settling a debt, acknowledged owing the debt in any way - including over the phone, agreed to pay it or been summonsed in respect of it, it has prescribed. Why am I now being harassed more than 7 years later?? I have had no communication with Nedbank whatsoever until late last year when the money was deducted.

Please close my account with you immediately and refund the money which was debited unauthorized, otherwise legal action will follow.
