Virgin Money South Africa
Lawyers need to learn about the law it seems

I am constantly being harassed by Anthony Richards and Associates on behalf of Virgin Money South Africa ("Virgin") for a debt dating back as far as 2007. Take note that (1) I have been sequestrated during November 2007 and Virgin was duly informed as one of the criteria for a sequestration order to be granted is that the judge must be satisfied that all creditors were duly informed, which they were - including Virgin. (2) The debt has, in any event, prescribed should you choose to ignore (1) - The Prescription Act 68 of 1969 provides in section 10 (1) that a debt is extinguished by prescription after the lapse of the prescriptive period laid down in that Act = 3 years. (3) In view of the aforesaid which one would hope attorneys and their not so bright collectors would at least know, I also object to being harassed at home as late as 20h00 at night and further advise you that listing prescribed debt on a credit bureau is specifically prohibited by the regulations to the National Credit Act and any attempt to list me will result in a complaint with the NCR. I trust I will not hear from you or ARA again.
