In 2000 I settled an outstanding credit card debt through FNB's appointed attorneys, Legator McKenna with a settlement amount. This was recorded through the local courts as well. At the beginning of November last year (2013) more than 13 years later, I received a call from Lenie at Groenewald, Lubbe Inc asking for the account to be paid. I have sent numerous mails to EDC Assist (FNB Legal), Lenie, Legator McKenna, Neville Patterson (my attorney) and contacted the courts to obtain the proof. Both Legator McKenna and Neville Patterson and the court have destroyed the files as it exceeds 10 years. The court also advised me that the matter is against the National Credit Act and the prescribed period has expired. I have also told Lenie at GLI to proceed with the legal action which I will defend and sue FNB thereafter. This is absolutely ridiculous that FNB can accept payment and then try and take legal action for the second time - for the same matter.
If only I was a lawyer!
