Non payment of motor excess charged

In August 2012 I was involved in a car accident in Pinetown (Durban). I had stopped at a robot and a car in front of me reversed into my car and causing damage to my car. Although Outsurance paid for repairs done on my car I was charged an excess of R3000. Up to now I have not yet received my excess back. When I phone my consultant from outsurance all they tell me is that they cannot contact the other party involved in the accident & not much progress has been made. I don't know whether Outsurance is chasing my case or not as I do not receive any feedback on the matter. I only get feedback (which is not of any help to me) when I ask for it. Are you guys working on my case or you've forgotten about it.
