Closure of the payment channel and handing over

I had a loan with Capitec and along the way had difficulties and could not keep up with payments. When I could pay I made payments to my savings account I have with them so that the money can be taken as before to pay my debt. When this did not happen I approached the bank to find out why they cannot take the payment. I was advised that the account has been handed over to attorney on 017xx in Mpumalanga. We called and they advised to wright to me and give details of how payment should be arranged. That was in October 2012. In January 2013, they sent their agent for to sign an arrangement.
I noticed that they brought the one for a small amount. I reminded the agent to confirm if both loans are with them and if so they need to send the bigger one so that I can sign.
? One loan on arrangement, second loan cannot trace.
? No summons served or intention to proceed with legal action.
? No registered letter of the intention to proceed with legal action
? No formal introduction that they have been appointed by Capitec-
? Settlement amount inflated by more that 50% of handed over amount.
? Legal fees and commision charged to consumer.
? Judgement taken outside my jurisdiction.
