Worst Service and Incompetency

I had an accident with by Bigboy, Insured through Smart Credit, on 13/04/2010. The claim was authorized and bike repaired but I had to pay round about R4700 in excess. After claim was finalized I phoned every few months sometimes every few days to find out what is happening with the recovery as the Third Party bumped into me and admitted he was guilty. I was promised to get feedback and that they are busy with the recovery and was not phoned back even once. I found out now that they never even started the recovery process and it is 3 and a half years on... A Perception was created that they will assist to recover the full amount to reimburse my excess but no efforts was made! I am very unhappy with the level of service and incompetency of people not forwarding my claim to start the recovery process as promised. I could have tried to recovery my excess myself in Small Claims Court but now it is to late. Wondering how Smart Credit will resolve this matter now?
