ABSA will not return R11 000

On January 25 2012 I made an internet banking transaction of R11 000 to the wrong ABSA account. I was only aware of this on Tuesday morning and went straight to my closest ABSA branch (Musgrave, Durban) to report this and get my money back. I spoke to Ronell Human who told me that the money was in the account and that it had been taken by the account holders vehicle finance. She then got ahold of the account holder who was not cooperative. She took my details and told me she'd sort this out for me. After a few weeks she called to let me know that ABSA couldn't give me back my money without written consent from the account holder, who she couldn't give me details for. I spent a month and a half trying to track down this account holder. I finally got ahold of him (through the help of Nedbank) and I got a call from Ronell a few days later saying that she was with this gentleman and he was willing to give the money back, only now she had deleted all documentation pertaining to this case. So I had to resend her all the documentation she needed. It's been four months and I still don't have my money back. I've run out of patience and am seeking legal advise.
