Galaxy note 2 not working

I dont know weather to complain to vodacom or samsung, but I received my galaxy note 2 in March this year.
Having had a samsung s2 I knew how the phone should perform. I left for a week on holiday and found that when taking pictures using instagram with a flash. The phone stalls. This never happened with my s2. So I whatsapped a friend of mine that also has a note 2 and he said his phone works fine with the app. Giving it the benefit of the doubt I reset my phone to factory settings. And I still had the same problem. I went to vodacom and they said they need to send the phone to be tested and I would be without my phone for a week. The phone has a micro sim so I wont be able to use it in another phone. This is a big problem for me. Seeing I got this phone to use for emails and for my business. Now my note 2 simply freezes up and I need to leave it for about 5 mins for it to just restart by itself. Frankly I am very disappointed in the note 2 and if I had the option I would like to give the phone back. I have reset the phone 4 times already. Same thingNow what do I do. Sit without a phone. Internet. Emails for a whole week... no. I pay R400 pm for this phone. Very unhapp
