Upgrade Failiure

I went into MTN shop at Irene mall and enquired when I can upgrade my phone, the guy told me that I can upgrade the 1 June. I asked if I can ugrade a month earlier because I was going abroad and needed a new phone urgently, as the old one is giving problems (Nokia N8). He told me that they can not assist me as THEY CAN ONLY UPGRADE FROM DATE ON THEIR SYSTEM. I told him that I read their upgrade T's and C's, and it clearly state that I can, this from their T&C: "The upgrade delegation process is as follows:
* Supervisor for upgrades in month 19-20 " . he said that that is not true. Now why do you have this in you T&C if you can not abide to it, and staff is not willing to assist clients. I dont want a new contract with another number just to get n phone, so all that is left is to cancel the contract, pay the fees and port to another network that is willing to assit me.
