I submitted a letter to [Email Removed] and via registered mail invoking Extinctive Prescription from Cell C in terms of the Prescription Act 68 of 1969 regarding an account opened on 05/08/2008. I stopped paying the account due to circumstances at the time in 2009 and was not contacted by Cell C since. I have phoned Customer Care on several occasions and have also conversed with consultants at their Legal Department in order to obtain a response regarding the matter, who refuse to provide me with details to someone who will in fact be able to respond in writing. I also find the consultants to be extremely rude and uninformed. A consultant I spoke with yesterday claimed that Cell C did try to contact me in Jan 2010 but was unsuccessful - however Cell C would have easily been able to trace my details from the information they had at their disposal. Furthermore, according to this consultant the initial debt was about R780 and now sits at about R5000 as the contract continued to run because I did not cancel it. Is it not standard practice for other SPs to suspend the account within 3 months of non-payment? I expressly deny liability to Cell C as the debt has prescribed.
