FAILURE TO REPLACE DEFECTED I-PAD

My Vodacom contract was due for an upgrade in Dec 13. After receiving a device with a defective display it was returned on the 3rd day. Their policy states return within 7 days. The device was sent for repairs. I followed up on the progress after it was promised that they will call me back, which never happened. On 16 Jan 14 I phoned the Vodashop and was informed that the device can be collected. The employee gave me the same box that I returned, but ensured me that it was a new device. I requested a sealed package but she told me that they can not give me a sealed box. The so called "new device" was full of dents. I refused to take it and requested a new device or my money back which they refused. Apparently their is procedures they have to follow. The manager is never available. On 18 Jan 14 I went to request an upgrade reversal. Elanie told me that she cannot do it on their system because the upgrade department is closed and promised that she would do it on Monday 20 Jan 14 and will phone me the afternoon. I am still waiting for the call. I pay for something that I don't have. They make promises and the whole time. All I want is a new device or my money back!
