Refusal of contract upgrade!

In March 2013 I ported from Cell C to Vodacom, I specifically asked the person that opened the account, that I do not want a device, as I already have an iPhone, and I want to upgrade when the new model is released towards the end of the year. When the 5s was released I put my name down on the website to be contacted for the upgrade. When they phoned me to confirm my order I was told that I was on a 24month contract and that I could not do an upgrade. How can I not upgrade when I did not take a device in the first place? Secondly I do not want to change anything on my account, as I am on the smart XL package I want to stay on the same package, and just get the iPhone 5s! I was told by the call centre that Andrew from the branch would contact me, he didn't, I sent another email requesting when will he contact me, the call centre responded on the 26/11/2013 that at 09:00 Andrew had been told to contact me. At 13:00 on the 26/11 I went into the store, as he had still not contacted me, I once again explained my story, he was adamant that I could not upgrade, but he promised to contact me by the latest 13:00 on the 27/11, it is now the 2/12 and I have still not heard from Andrew???
