Supply of defective Cellphone

The Cell C Boardwalk store has provided me with an out of the box defective device, that was not replaced as explained in the store where if I picked up any defects within the first 7 days I would receive a new replacement device. The Cell C Boardwalk also store blatantly regarding the first OBF submittal where there was actually no software upgrade done even though it was communicated as such. I do not see any solution availing from the communication I have received from the Cell C store and management. As a consumer in South Africa I have the right to receive safe and good quality goods, which I have been denied thus far. I also have a right to demand a quality service, which has also been denied thus far. I have still yet to receive a new replacement device (defect free) or use the cellular service that I signed up for and am paying for! It has been 2 weeks since I took the contract out with still no resolution of my problem. I cannot accept the fact that I have to pay for the next 24 months for a contract and device which I will not be able to use as it is intended.
