STORE WON'T REPLACE A DEFECTIVE PHONE

On the 19th December 2012 at 16H22 I bought a cellphone from Markham and noticed defects in just a few days. The screen went blank, the software hanged/freezed and depicted a black and white screen. Games and the internet were inaccessible. I went to the store on the 25th December 2012 but the store was closed for business. I went to store again on the 26th December 2012 at 13H30 but found that the store had closed at 13H00. I then returned to the store on the 27th December 2012 and the store assistant tested the device and found it defective. I was told that had I come within 7 days I would have qualified to receive a new cellphone but instead I came on the 8th day and therefore the store can only send the phone for repairs. I am disputing the time frame as the store was not open on the 25th December 2012 and demand a new cellphone instead.
