S4 issues with battery

I have had this phone now for 3 months - since the weekend the phone switches on and off even though the battery shows charged, I took the phone to Vodafone shop in Carnicall and said the phone needs a new batter? Why should I pay for this when this phone is still new?
I want to settle this contract end of December but I will not do so and will post this back to Vodcaom if they do not drop off a new battery at my work!!!
All the charges that I am using I bought at Vodashop for the phone - my brother in law had the same problem and he had to wait for 3 weeks?
