Phone insurance sold under false pretences

Sunday morning I had the misfortune of dropping my Lumia 800 smartphone, shattering the glass and rendering the touch screen unusuable. I took great solace in the fact the Nashua store representative at Sandton City had convinced me to take out an additional insurance policy "on the phone" at the time I procured it more than a year ago.

I duly reported back to the same store and comfort turned to dismay when I was informed I was not covered as I had never made use of the Nashua SIM card supplied with the device (within my rights to do so, I believe). A subsequent thorough inspection of the t&c confirmed this.

I am irate as the salesperson never informed me of this crucial distinction. In fact the entire body of the promotional material on the Nashua website w.r.t to "Cellphone insurance" does not even reference the words "SIM card" or "Phone Number", incredulous considering they form the pivot of the insurance product and not the device itself.

A reasonable person can only assume this marked disparity between the t&c and promotional material is obfuscation.

Not only have I lost my phone buy I have paid 1 years of premiums for which I was never actually covered.
