Wrong phone. Refusal to replace in terms of CPA

My father - Mr Herbert Schonberger was entitled to an upgrade of his phone in terms of his contract with Vodacom. He was showed a phone - the Nokia 306 in the shop. He could not use the phone there as it was a demo model. It has an electronic keyboard that he finds impossible to work. It takes him over an hour to figure out how to send a simple s ms.

He returned the phone well within the period demanded by the Consumer Protection Act, and has requested that a more appropriate phone be supplied to him.

This is the response from Kirsten McGuigan - the Client Liaison office at Vodacom Western Region - telephone 082 274 5262.

It is completely unacceptable. Mr Schonberger cannot use this phone and is entitled to get a new one or cancel the contract.

Please note that we have a 7 day return policy, if the Client did not have an opportunity to see the phone first.

However, this phone was given to Mr. Schonberger, two months ago, and therefore we cannot accommodate his request.

We will be able to explain to the Client how to send an SMS on the phone - this can be done at any of our Vodacom stores.
