New Phone with a virus

I was handed a new phone (Samsung Galaxy S3) due to my upgrade on my contract, I was called and told to please come fetch my phone which I gladly did, when I collected the phone the agent helped me and gave me my new phone, 9 days later my phone would not switch on and when it finally came on it had a pink screen, so I took the phone back thinking it would be a quick repair and is just a manufactures fault, but the agent on duty notified me the phone has a virus and cannot be repaired they would have to send it away and as soon as they get the OBF number they will hand me over a new phone which she stated would take 3 to 4 working days which was 9 workings days ago, when I collected the phone the manager said that I was supposed to be notified to down load a anti virus on the phone as soon as I switch it on which no one did, they do agree it is there fault and yet I am still sitting with no phone, I have been to the agent several times and just get told that I have to wait, which makes matters worse my income comes from my phone which I need.
