Contract upgrade

I live in 3 provinces, here goes my sad story...

I had an MTN contract of Nokia E7, on the 27th of June 2013 I upgraded to Nokia Lumia 720 on R249 package for 24 months in Witbank Mpumalanga, great service I got from Gareth. I went toTzaneen Limpopo, on the 9th of July that's when I started having problem with the handset which couldn't switch on. On the 16th of July I booked the phone/handset at MTN Midrand Head Office Gauteng with this ref number 3599133 and given collection number COL0331052558 .

Now, I no longer want Nokia Lumia 720 since I heard few people complaining about the handset. I've asked Witbank branch to exchange it with Sony Xperia V which is in the same package with Nokia Lumia 720. My request has been declined of which I fail to understand why??? MTN Head Office in Midrand will replace the previous handset with the new one not refurbished one. WHY CAN'T THEY EXCHANGED THE HANDSET. I feel like my rights as a customer has been violated!
