No consumer protection act applies here

I bought a Sony Go mobile phone on Sunday night at their Waterfront branch and was told that I could return this with 7 days if there were any issues or problems with the device. We spent all day Monday trying to get the phone to work, gave up on Monday night after many attempts to download the required software and called the branch on Tuesday morning for advice - was told that someone would call me back. I eventually gave up waiting for the return call and went in to the branch where was told it would take 24 hours to upgrade / repair at which point I stated i could not be without a phone any longer, after already had a day on a film shoot without a working handset. A refund was refused after I was told that I had to fill in forms and Vodacom would decide if i would get refunded IF they decided the handset was defective, which it obviously it was or I would have been standing in the store trying to get it sorted out. If they were to decide it was a software issue and not refund I would then be stuck with a brand new phone that would simply never work.
