Consumer Protection Act - MTN

I (regrettably) renewed my contract with MTN 6 days ago, whereby I received the Blackberry Q10.
After having numerous issues with the device over the weekend, (such as not being able to make calls, emergency calls only, calls not coming through, having to restart the phone 3 times a day).

I returned the phone to MTN Fourways branch, spoke to the manager, I informed him of the problems i was experiencing with the devices. I requested that the Blackberry Q10 be returned, and they provide me with another phone - as i was still within my 7 day period from receiving the phone). Personally, Blackberry is not what they used to be. Not happy with device.

He said that there had to be a technical problem with the phone, he has to send it in for repairs. this would leave me without a phone, for who-knows how long, until MTN figure out the problem.

Surely the Consumer Protection Act protects consumers against operators such as MTN?

I am currently on day 6, and all they said was sorry, nothing more they can do. Either i send it in for repairs or sit with the device as is. So now I have to sit with this problem for 2 years!!

This is extremely concerning to say the least.
