SHOCKING SERVICE - PHONE STOPPED WORKING ON DAY 2

Mid December 2012 i received a blackberry 9380 phone from my insurance, on day two it stopped working (broke). i then phoned my insurance and informed then about this dilemma then they referred me to the game store opposite southgate mall . when i got to the store i was absolutely perturbed by the lack of customer service i endured . i explained the issue to the staff for about 1hour min, to my disappointment the service i received was absolutely horrendous, they informed me that i need to go to my insurer and they cannot help me . only after i requested a manager then they were will to listen to my query . the store manager told me the same story that the staff told me which was no help to me whatsoever . only after i asked for my money back they were willing to send my query to the claims dpt . to my knowledge as a customer in South Africa - the Cpa (consumer protection act) states that any good received that get damaged within 7 days should be replaced immediately by the seller upon clients request. i came back after 2 weeks only to find out nothing has been done to my phone - in this period i receive no correspondence from game .i eventually took my phone to my insurance
