Damaged Phone

I bought a 9320 Blackberry limited edition phone within 3 months of purchasing it the cover of the phone was already peeling off and i had it insured with them now when i took it for them to repair they told me that they dont any physical damages now m stuck with a phone that is peeling off cause they told me there is nothing they can do about it and to think that I'm still paying for a phone that I'm not happy about...

I would really appreciate if you can assist me on this matter.
