Taking Legal Action Against Homechoice

I have ordered a Suffolk Electronic Heater from Home choice which pon delivery it was discovered that the heater's front glass was broken. I logged a call with them on the 15th May 2013 (customer care agent who assisted me was Siphokazi Maliwa: Ref: 1172307027). The heater was collected a few days later and to date I have not yet received a replacement one from them. I have already made two monthly payments (six month credit). I have since made follow ups (29 May 2013 spoken to Masibulele Mabhuda: Ref no 117530533) and Levina Boltman: Ref no 1180 45443. After I have not received any assistance I wrote a complaint at Hellopeter and received a feedback from Home choice that they will send a replacement heater soon but will not confirm how long the process may take. I called again today and the customer agent said that there is no stock of the heater. I asked to speak to Levina Boltsman AND WAS PUT ON HOLD OR THEY JUST PUT THE PHONE ASSIDE. I am taking legal action against Homechoice. Its the middle of winter but I dont have the heater that I am paying for. I have already approched the Consumer Protection Commission and the NCR
