Harcourts
Failure to heed Consumer Protection Act cooloff

I listed my property on [URL Removed] to test the market regarding selling and see if I could get a direct buyer. After it had been on the site for a month or so I got a call from Harcourts saying that they can assist me in selling the property. They came to see me and discuss the marketing strategy for selling the house, which I thought was good. I subsequently signed the sole mandate. However, within the 5 day cooloff period I was not happy as they were not holding to the marketing strategy that they had agreed with me and I found their work unprofessional. I therefore stated that I was invoking the cooloff period clause to terminate the mandate, as they had contacted me directly and therefore it constituted direct marketing. They refused to agree that I was entitled to the cooloff provisions as they contended that they had not engaged in direct marketing because they "had not knocked on my door". I will see out the mandate if necessary but will never use Harcourts again nor buy a house marketed by them in the future.
