When I received offer to purchase, as seller, I noticed that the agent had already signed the offer to purchase before I, as 2nd seller had.
Given that I felt pathetically poor service was a valid reason for reducing commission, I did. To 5%! And that, in my opinion, was still far more than I should be paying!
I was called by Elisme Swart, Principal of Pam Golding Properties Lydenburg, who threatened to cancel the offer to purchase should I insist on the 5%. I Insisted! The offer was not cancelled. Instead, the threats started!
Between Gerda Whitehorn and Elisme Swart, legal action and court process were threatened, until there was an ultimatum from myself as seller - accept the 5%, or I, as seller, cancel the deal by close of business on a Monday.
An sms was received from Gerda Whitehorn accepting the 5% on behalf of the company, and "in the best interests of our clients" by 16h00 of the relevant afternoon.
Almost a week later, an email from Gerda Whitehorn: "I need you to know that we did not capitulate for any monetary reason - to the contrary. On legal advice we know that we would easily have won the commission battle"
As a seller I will not be threatened!
