Refusing to assist with own erro

On 29 October 2013 at 17:30:32 a lay-bye was made for a pair of Superga Cotu Classic takkies was made- Lay-by no 2020047350. The amount paid was R250. Second and last payment was another R250 made on 23 November at 16:23:29. It was then realised that the received takkies were the wrong size. a size 7 instead of size 6. On 27 October the shoes were returned to the store for an exchange. The store didn't have the size and checked for another branh that had it. We went to the Canal walk branch, only to be given a mouldy pair of takkies in the correct size by SIfiso Khumalo, which we refused. This morning i went to the Cape Town concourse branch and the very scenario played out being forced to take a mouldy size 6. I am beyond livid, and the store refused to refund me. In terms of the Consumer Protection Act (CPA) section 56 If within 6 months after a purchase, the goods are found to be in contravention of the above, a consumer is allowed any of the three R's: Replacement, Refund and Repair. I don't even want the takkies anymore, I want the money back!!
