My husband was retrenched in May 2009. He had then gone under debt counselling to seek relief from his debt and pay smaller instalments however Nedbank was the only company giving him hassles despite receiving payments. Eventually it was handed to Strauss Daly for collections and a judgement listed against him whilst he was still making payments. Today I was making some enquiries on his credit record as a result of our hijacking and was alerted to the fact that a court can only grant a judgement only if the debtor has signed and acknowledged a final demand or a consent to judgement which my husband did not do in this case. I now require copies of these documents as my husband never signed this documentation, I would therefore like to view the signatures on this documents as I was also alerted to the fact that many collection agents and attorneys are not coming out to the debtors but rather forging their signatures just to have a judgement listed. Please send me these documents as soon as possible. I strongly advise that other consumers be alert to this as well and investigate your credit reports.
