INCORRECT PHONE DELIVERY

A wrong phone was delivered to me yesterday 12/03/13 I have ordered a BB Z10 and instead received a BB 9790. I have been given the run around between FNB and Cell C Direct and they were not prepared to sort out the problem immediately. I have to speak to the same person who made the sale and this Ryan Pillay is a very difficult person to get hold of. When he phoned me back he told me that in the terms and condition it is stated that they are not held responsible for the wrong phone delivery. Which I know was not specified when I spoke to him, he said that the colour of the phone can not be guaranteed. I don't want this phone, i would really like them to come fetch this phone and not charge me for delivery charges, and bring me the phone I have ordered. If they going to give me grief I want to cancel the whole contract and go to another service provide. They have ported my number to cell c, and now my old sim doesn't work and I don't want to activate the new phone as I might get charged for something which i didn't want.
