I took a car insurance with New National underwritten by Affinity, I took it over the phone. They said that drivers must be disclosed and I gave them names, knowing that these are regular drivers. I asked the consultant to send the contract to me of which he never did. On the 15 Dec 2012 the car had an accident and it was driven by my brother in law. I sent in my claim, it was declined on the basis of driver not been disclosed so he is not covered. I then requested the contract and it was clear on the fact that no cover for the driver who is not disclosed. Was this a fair business practice? Because if I had the contract I will read it and understand the terms and conditions. The contract states it clearly that it is the responsibility of the client to read and understand the terms and conditions of the policy. I felt that I was not given the chance to exercise my responsibility as required by the contract. I thought we had a an agreement ie to send the contract.
