I became in arrears with my absa homeloan and signed a help u stay agreement (with clause 3.2 being the help u stay condition of the agreement). Clause 3.2.2 clearly indicates absa will writ eoff 30% of the debt if they have to sell the property.
Unfortuantely ABSA has decided to sell the property (without properly marketing it) on auction and they are refusing to write off the 30% of the debt as is in the agreement, on black and white!!
Furthermore I have brought two very good guaranteed offers to purchase to ABSA which they decline.
ABSA is committing by changing the terms of the contract to suite themselves and saying no such agreement exists, yet I have it and have forwarded it to them. Andre Jonker at ABSA says ABSA refuses to write off the 30% even though it is in the agreement.
