MTN SP dont want to fix my phone

To Whom It May Concern
I took in my phone for repair as my phone screen broken due to the phone fell on the floor by accident. I was
informed that my warranty would not cover the damages as it broke due
to negligence and I would have to pay for the cost of repairs, I
explained to the consultant 'Deovan Nail' what had happened and that it was an
accident, and my phone 'blackberry 9790 was a refurbished
phone.

I explained to the consultant what had happened and that the phone
fell by mistake, which by mistake in simple terms is an accident. He told me that it's in the terms and conditions in my cell phone contract.
In the definition section of the contract of words, they dont mention how negligence is defined By MTN SP and also when I read through the terms and condition regarding negligence, it was very vague.

I called the MTN customer care centre and spoke to gentleman by the
name of Edwin Moorkey 06/01/2014 call ref number 107834253 whom was not much of help. I was
assisted by Ms Ngobeni 'ref number 107845904 07/01/2014' from head office at the
contract department whom also was not much of help regarding my matter

All i ask for mt to fix my phone at no cost to me.
